PRIVACY NOTICE

In compliance with the FEDERAL LAW FOR THE PROTECTION OF PERSONAL DATA IN POSSESSION OF PRIVATE PARTIES (LEY FEDERAL DE PROTECCIÓN DE DATOS PERSONALES EN POSESIÓN DE LOS PARTICULARES), hereinafter “LFPDPPP”, GC GUILLÉN Y ASOCIADOS, S. A. DE C.V., with domicile at Avenida Insurgentes Sur 662, int. 10B, Colonia del Valle, Alcaldía Benito Juárez, Zip Code 03100, Mexico City, hereinafter the “RESPONSIBLE PARTY”, recognizes the importance of the legitimate, controlled and informed treatment of the personal data and sensitive data, if any, provided by the natural person to whom the same correspond, hereinafter the “OWNER”. Therefore, it has established the following provisions to protect such information.

The RESPONSIBLE PARTY collects your personal data for the purposes mentioned in this Privacy Notice. In this context, we inform you that your personal data will be treated and safeguarded based on the principles of legality, quality, consent, information, purpose, loyalty, proportionality and responsibility enshrined in the LFPDPPP.

Thus, the personal data that may be requested, including but not limited to, are the following: i) Identification data: signature, date of birth, age, nationality, marital status, Unique Population Registry Code (CURP); ii) Contact date: address, mobile and/or landline telephone and email; iii) Financial or patrimonial data: fiscal data; billing address, Federal Taxpayers Registry number (RFC), bank details, etc. Personal data that will be requested strictly for the purpose of fulfilling and executing the contracted legal services. The information provided by the OWNER, will be used by the RESPONSIBLE PARTY, for the purposes strictly necessary to carry out in a responsible, professional, objective, and ethical manner, any type of services of a legal nature that are requested by the OWNER; which may consist, including but not limited to, any type of consultation, opinion, procedure, management, litigation, advice, preparation of documents and any other similar, in the understanding that all information requested and provided will be necessary for the legal relationship that is generated.

In addition to the personal data mentioned above, the RESPONSIBLE PARTY may request sensitive personal data that require special protection, and therefore, obviously will be treated with professional ethics, such as: issues related to the health of the OWNER, as well as the religion practiced, affinity with certain political ideology, and, where appropriate, sexual orientation; in such case, the RESPONSIBLE PARTY will be responsible for obtaining your express written consent prior to collecting and treating them according to the purposes set forth in this Privacy Notice. 

It is necessary to point out that this Privacy Notice applies to both personal information and location information provided by the user in person or automatically by the browser used by the user, including the IP address, the page requested, as well as the means by which they arrived at “guillen-garcia.com”. Thus, the RESPONSIBLE PARTY, may directly collect the personal data of the OWNER when the latter requests the services or when they visit the website on the Internet.

The RESPONSIBLE PARTY will not sell, assign or transfer the personal data of the OWNER to third parties, national or foreign, external to it without prior consent. However, the RESPONSIBLE PARTY may transfer personal data without prior consent when such transfer is under the assumptions provided in Article 37 of the LFPDPPP, or other applicable legal and administrative provisions. In such cases, the RESPONSIBLE PARTY will ensure that such third parties maintain the necessary confidentiality and security measures to safeguard your personal data, as well as that they only use your data for the purposes for which they have been transferred and in accordance with this Privacy Notice.

The RESPONSIBLE PARTY has adopted reasonable technical, physical and administrative security measures to ensure the confidentiality of the personal data of “THE OWNER”, as well as to avoid its damage, loss, alteration, destruction, use, access or unauthorized processing. In this context, you may limit the use or disclosure of your personal data by sending your request in writing either in person at the office of the RESPONSIBLE on business days from 10:00 to 17:00 hours, or by email to the following address contacto@guillen-garcia.com.

As the OWNER of the personal data subject of this Privacy Notice, you may exercise before the RESPONSIBLE PARTY the rights of Access, Rectification, Cancellation or Opposition (ARCO rights) provided in LFPDPPP. Likewise, the OWNER has the right to revoke in whole or in part, at any time, the consent given and necessary for the processing of personal data, as well as to limit the use or disclosure of such data. The above, by sending your written request either personally, or by email to the following address contacto@guillen-garcia.com, on business days from 10:00 to 17:00 hours, where our staff will process your request and address any questions about it. 

On the other hand, the RESPONSIBLE PARTY reserves the right to make changes to this notice, in which case, it will communicate such situation on its website guillen-garcia.com or by sending a message to the address that the OWNER has provided. Such changes shall be deemed accepted by the OWNER, if within 5 business days following the publication or receipt of the mail, does not express its disagreement.

If the OWNER considers that his right to protection of personal data has been injured by any conduct of employees, actions or responses of the RESPONSIBLE PARTY; assumes that in the processing of his personal data there is any violation of the provisions of the Federal Law on Protection of Personal Data in Possession of Private Parties, may file a complaint or claim before the INAI, for more information, please visit home.inai.org.mx.
